The law in relation to fatal injuries claims are different to normal claims for compensation.  There are different heads of claim and there are strict rules as to which relatives are entitled to compensation and those who are not.

There are also time limits for fatal injury claims.  If the person who has been injured or suffers from an industrial disease has not timebarred the case before they die (see the time limits in other sections of the website) then the time limit will be 3 years from the date of their death.  That is the Executor or relative who may have a claim arising out of the death will require to commence proceedings within 3 years of the date of the death.
