Some fractures can be simple and heal with no long term consequences. Others can cause long standing complications such as a weakness or osteoarthritis.
If you settle your claim on a full and final basis on the assumption that the injury is a simple one but there turns out to be such a complication you will have no right of Redress to go back and get more money for the deterioration.
If you suffer a fracture you therefore must instruct the services of an expert lawyer who is alive to these issues and who will conduct your fracture claim accordingly.
At Redress we ensure that you are examined by an expert Consultant Orthopaedic Surgeon who will specifically address and consider the long term effects of your injury.
If there is a risk of future complications we will discuss this with you fully and ensure that the risk is accounted for by either negotiating a suitable uplift in your damages or by seeking provisional damages which specifically (and unusually) maintains your right to further compensation if there is a serious deterioration in your physical condition.
We can also ensure that you receive the best possible care and treatment in order that your injuries last for as short a time as possible and to ensure that the disruption to your life is kept to a minimum.
As well as arranging the services below we will ensure that the insurers for the party who caused the injury meet the cost of those services.
- Operative treatment. If you will benefit from an operation and the NHS waiting list is too long we will seek to negotiate the cost of the operation, on a private basis, as part of your just recompense.
- Physiotherapy or alternative treatment such as chiropractors of reflexology can also be arranged and paid for by the insurers.
